These Terms of Service (“Terms”) govern your access to and use of the website located at hardmoneylendersofaustin.com (the “Site”), operated by Lead Skills, LLC d/b/a Hard Money Lenders of Austin (“we,” “us,” or “our”). By using the Site or submitting an inquiry through our forms, you agree to these Terms. If you do not agree, do not use the Site.

Our Role: Lead Generation Service

Hard Money Lenders of Austin is a lead generation service. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions.

When you submit an inquiry, we share the information you provide with one or more participating hard money lenders who may contact you directly about financing. Any loan offer, approval, funding decision, rate, term, or condition is made solely by the participating lender based on that lender’s own underwriting criteria. Submitting an inquiry does not guarantee you will be matched with a lender or receive a loan offer. All loan products are subject to borrower and property qualification by the participating lender, and not all applicants will qualify.

We receive compensation from participating lenders for connecting them with potential borrowers. This compensation does not influence your cost, the terms you are offered, or whether you are approved for a loan.

No Offer or Solicitation

Nothing on the Site constitutes an offer or solicitation to lend, a commitment to lend, or a guarantee of any specific loan terms. Information presented on the Site is for general informational purposes only and is not financial, legal, tax, or investment advice. Rates, terms, and program availability vary by participating lender and are subject to change without notice.

Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Site. By submitting an inquiry, you represent that the information you provide is accurate, complete, and that you are the person identified in the submission.

Your Consent to Be Contacted

When you submit a form on the Site, you consent to be contacted by us and by one or more participating lenders at the phone number and email address you provided, including by autodialer, prerecorded voice, SMS, and email. Consent is not a condition of receiving services. Message and data rates may apply. You may opt out of text messages from us at any time by replying STOP, or opt out of phone and email contact by calling (512) 883-2092 or emailing [email protected]. Opting out of contact from us does not automatically opt you out of contact by a participating lender; you must contact each lender directly to opt out.

Hard Money Lenders of Austin connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

Acceptable Use

You agree that you will not:

  • Submit false, misleading, or fraudulent information
  • Submit information about a third party without their authorization
  • Use the Site for any unlawful purpose or in violation of any applicable law
  • Attempt to interfere with, compromise, or disrupt the Site or its security
  • Use automated means to access, scrape, or collect content from the Site

Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Lead Skills, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from the content without our prior written permission.

Third-Party Links and Services

The Site may contain links to third-party websites or services, including those of participating lenders. We do not control and are not responsible for the content, privacy practices, or terms of any third-party website or service. Your dealings with any third party, including any participating lender, are solely between you and that third party.

Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY INQUIRY WILL RESULT IN A LOAN OFFER.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR YOUR INTERACTIONS WITH ANY PARTICIPATING LENDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify and hold harmless Lead Skills, LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas for any dispute arising out of or relating to these Terms or the Site, subject to any binding arbitration requirement set forth in a separate agreement.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.
